Terms and conditions
These terms govern your use of the Arcla platform and website operated by Third Frontier Ventures Ltd. trading as Arcla (“Arcla”, “we”, “us”, “our”), a company registered in England and Wales at 19 Averill Street, 1st Floor Apartment, London, W6 8ED.
By accessing or using our services, you agree to these terms. If you do not agree, you must stop using the service immediately.

1. Our services
Arcla provides AI-driven sales enablement software for sales teams. This includes real-time call coaching, script and playbook management, live objection detection, AI-assisted answer surfacing, conversation analytics, and post-call feedback tools.
The services are designed for business use. They are not intended for personal, domestic, or consumer use.
2. Accounts and access
You must register for an account to use the platform. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must notify us immediately of any unauthorised access.
Arcla reserves the right to suspend or terminate accounts that violate these terms, engage in prohibited activities, or have been inactive for an extended period.
3. Call recording and compliance
Arcla listens to and analyses live sales calls. You are solely responsible for ensuring that all parties to any call processed through Arcla have given the necessary consent to recording and AI analysis, in accordance with the laws of your jurisdiction and theirs. This includes but is not limited to compliance with UK GDPR, the EU GDPR, the US Wiretap Act, and any applicable state or local recording consent laws.
Arcla does not accept liability for your failure to obtain appropriate consent.
4. Acceptable use
You may use Arcla only for lawful business purposes in accordance with these terms. You must not:
- Use the service to record or process calls without legally required consent.
- Attempt to reverse-engineer, decompile, or extract source code from the platform.
- Use the service to harass, harm, or discriminate against any person.
- Share, resell, or sublicence access to the platform without our written permission.
- Upload or transmit malicious code, or attempt to gain unauthorised access to our systems.
- Use the platform in a way that violates any applicable law or regulation.
5. Subscriptions and payment
Access to Arcla is provided on a subscription basis. Fees, billing cycles, and payment terms are set out in your order form or subscription agreement. All fees are payable in advance and are non-refundable unless otherwise agreed in writing.
We reserve the right to update pricing with reasonable notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
6. Cancellation
You may cancel your subscription at any time by contacting us. Cancellation takes effect at the end of the current billing period. We do not issue refunds for unused portions of a subscription period.
7. Intellectual property
All intellectual property rights in the Arcla platform — including the software, AI models, playbook templates, design, and content — belong to Third Frontier Ventures Ltd. or our licensors. These terms do not transfer any ownership to you.
Your data (call recordings, transcripts, CRM data, playbook content you create) remains yours. You grant Arcla a limited licence to process your data solely to provide and improve the service, as described in our Privacy Policy.
8. User-generated content
You may upload or create content within the platform such as playbooks, scripts, and call notes. You are responsible for ensuring this content does not infringe third-party rights, violate applicable law, or contain harmful or illegal material. You grant Arcla a non-exclusive, worldwide, royalty-free licence to use this content to provide the service.
We reserve the right to remove content that violates these terms.
9. Confidentiality
In using Arcla you may gain access to non-public information about our platform, technology, or business (“Confidential Information”). You agree to keep all Confidential Information strictly confidential, use it only for the purposes of using the service, and not disclose it to third parties without our prior written consent.
This obligation survives termination of your account for three years, or longer if required by applicable law.
10. Privacy and data processing
Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these terms.
Where Arcla processes personal data on your behalf — including call recordings and transcripts that may contain the personal data of your prospects and customers — we do so as a data processor acting on your instructions. You remain the data controller for that data and are responsible for:
- Ensuring you have a lawful basis for processing (including any required consent from call participants).
- Responding to data subject rights requests from your prospects and customers (access, deletion, correction, etc.). Our platform provides administrative tools to locate and delete recordings and transcripts on request.
- Complying with your own obligations under applicable data protection law, including UK GDPR and EU GDPR where applicable.
We will provide reasonable assistance to help you meet data subject requests and will delete personal data from our systems upon your instruction or on account termination, subject to our standard retention periods and legal obligations. Full terms governing our processing of your customers’ data are set out in our Data Processing Agreement, available on request.
11. Third-party integrations
Arcla integrates with third-party platforms including video conferencing tools, CRM systems, and communication platforms. Your use of those integrations is also subject to the third parties’ own terms of service and privacy policies. We are not responsible for the practices of third-party services.
12. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance, release updates, or modify or discontinue features with or without notice. We will use reasonable efforts to communicate planned downtime in advance.
13. Disclaimer
The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that AI-generated content will be accurate.
You should not rely solely on AI-generated answers during calls without exercising your own professional judgement.
14. Limitation of liability
To the fullest extent permitted by law, Arcla and its affiliates will not be liable for any indirect, consequential, incidental, or punitive damages arising from your use of the service, including lost profits or data loss. Our total liability to you in any twelve-month period will not exceed the fees you paid to us during that period.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
15. Indemnification
You agree to indemnify and hold harmless Arcla, its directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your failure to obtain required recording consent.
16. Governing law and disputes
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. Before initiating formal proceedings, you agree to first attempt to resolve any dispute through good-faith informal negotiation for at least 30 days.
17. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email or prominent notice on the platform. Continued use of the service after the effective date of changes constitutes acceptance of the updated terms.
